Trust Administration

Probate Administration

Probate is the legal process by which a person’s assets are distributed after death. To the fullest extent possible, it is a good idea to attempt to minimize what has to go through a legal probate process. This can be done using estate planning tools like trusts, wills, or other vehicles.

Asset Protection

Asset protection (sometimes also referred to as debtor-creditor law) is a set of legal techniques and a body of statutory and common law dealing with protecting assets of individuals and business entities from civil money judgments. The goal of asset protection planning is to insulate assets from claims of creditors without perjury or tax evasion.

Guardianships

Many people have an incorrect understanding of the wide range of legal matters guardianship can cover. They often assume that guardianship will only come into play should they become unable to care for their minor children (or adult children who can’t take care of themselves). The fact is, however, that legal guardianship is more often going to be there to choose who will make legal decisions on YOUR behalf should you become unable to do so.

Probate, Trust and other Litigation

By statute, a will must be properly drawn and its provisions regarding the disposition of the decedent’s assets must be followed. But closing an estate’s affairs is not always a smooth process. Undue influence in the creation of a will can lead to a party contesting a will, and allegations of malfeasance during the probate process can result in litigation.

For a  business that is owned by a few individuals such as members of a family, business succession involves planning proactively for the transition to new management and to new controlling ownership after the senior or majority owners and managers die, retire, or become disabled.
